AUCTION TERMS AND CONDITIONS

1. OBJECT
The purpose of these Legal Bases is to regulate the terms and conditions of the auction
online organized by REAL SPORTING DE GIJÓN, SAD, (hereinafter, "Real Sporting"), with
registered office at Camino de Mareo a Granda, number 645, in Mareo de Abajo, (333390),
Gijón council and with CIF nº A-33608233, is the organizer and promoter of the auction,
consisting of finishing off the shirt (hereinafter, the “Shirt”) used by the musician and
singer Enol in the video clip made in collaboration with Real Sporting for the publication
from the song “Es mi Gijón” (hereinafter, the “Auction”).
The Legal Bases may be consulted by participants on the Web page

2. TERRITORIAL AND TEMPORAL SCOPE
People residing in Spain may participate in the Auction, which will begin on
next August 9, 2024 (“Start Date”) at 12:00 hours (Spanish time) and will end
next Monday, August 19, 2024 at 12:00 p.m. (Spanish time) (“Deadline”).
1. PERSONAL SCOPE
Only people who meet all the requirements may participate in the Auction
established in these rules. All those who are eligible to participate in this Auction
persons (hereinafter, "the Participants") who are over 18 years of age, resident in
Spain.
The following are excluded from participation in the Contest:
- Persons who are not over 18 years of age.
- People not resident in Spain.
- Employees, directors and advisors of Real Sporting.

- Fraudulent profiles.
Participation through agents or third parties is also not permitted, nor is the use of multiple
identities.
3. FORM OF PARTICIPATION AND CONDUCT OF THE AUCTION
In order to participate in the Auction, the following conditions must be met:

2. The starting price will be ONE HUNDRED AND TWENTY (120.-€). To purchase the T-shirt, the
Participant must bid at least ten (10) euros more than the previous bid or the
starting price.
3. The status of the Auction will be visible on the Real Sporting online store website,
where each Participant will be able to observe the status of the bidding. Likewise, Real Sporting will go
notifying the last bidder when their bid has been outbid.
4. Upon the Deadline, Real Sporting will notify the highest bidder of the end of the
Auction and request, via Whatshapp message and/or via email
facilitated by the Participant, the payment of the price. Said payment must be made
within 30 minutes of communication.
5. In the event that the highest Participating bidder does not make payment of the price within the specified period,
established above, will lose the right to acquire the Shirt, and Real will proceed
Sporting to inform the second highest Participating bidder of the possibility of acquiring it,
The payment must be made within 30 minutes of the communication.
In the event that the second highest Participating bidder also fails to make payment within the time limit
previously established, the Club will notify the third highest Participating bidder and thus
successively, until payment is finally made.
6. Once the highest bid has been paid, the winner of the Auction will be able to pick up the T-shirt at
the dependencies that Sporting duly communicates to you or, you may request that it be
sent to your home, with shipping costs being the responsibility of the auction winner.

Likewise, Real Sporting will not accept changes or returns once the purchase has been made.

4. ACCEPTANCE
Participation in this Auction implies acceptance by participants of all the conditions

waiving any claim regarding the legal bases of the Auction.
5. TAX OBLIGATIONS
The prizes will be subject to current tax legislation, and the winner must assume the
tax obligations that apply to you in relation to obtaining the prize.
In the event that the winner is a resident of Spain and the value of the prize awarded for the purposes
of withholdings exceeds the amount of €300, it will correspond to and be the responsibility of Real Sporting,
Payment of the corresponding income on account according to the rates that are in force at the date
of the accrual of the operation. The payment on account will not be passed on to the winner, being
assumed by Real Sporting, so this income will mean a higher value of the prize in
kind received by the winner.

exposed, the corresponding certificate of withholdings and payments on account.
6. RESPONSIBILITIES
Real Sporting reserves the right to eliminate any participant who defrauds, alters
or render useless the proper functioning and the normal and regulatory course of this
Auction.
Real Sporting reserves the right to not accept the participation of a person in the
Auction if it does not comply with the conditions detailed in these conditions.
Real Sporting also reserves the right to invalidate the participation of those
users who attempt to participate through fraudulent means, or for fraudulent purposes or
illegal. All of this without prejudice to the appropriate legal measures that could be taken according to
the circumstances of each case.
Real Sporting will be exempt from all responsibility towards the participants, if for
due to force majeure or legal imperative should this be cancelled or suspended
Auction, a situation that would be conveniently brought to the attention of the Participants.
Real Sporting is exonerated from any type of responsibility regarding the incidents
that, beyond their control, could be caused to the participants and the winner of the Auction.
Real Sporting is in no way responsible for the treatment that the media

communication they grant to the Auction and in particular to the personal data and images of the
participants and/or winner, and is therefore exempt from any liability in relation to
possible claims from the winner, participants and/or third parties that may
occur as a result of the opinions and/or statements expressed and/or the use
of the images and/or personal data that the media may carry out in relation to the
participants in the Auction and/or persons who may appear in the images.
Real Sporting excludes any liability for damages of any kind.

7. INTELLECTUAL PROPERTY

8.1 WHO IS RESPONSIBLE FOR THE PROCESSING OF YOUR PERSONAL DATA?
